Welcome to KillerBot. These Terms of Service ("Terms") govern your access to and use of the KillerBot platform, website, and services (collectively, the "Service") operated by KillerBot ("we," "us," or "our") at killr.bot.

Please read these Terms carefully before using the Service. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

KillerBot is a managed AI assistant platform that provides each user with a personal, private AI assistant powered by Anthropic's Claude. The Service includes conversational AI, web search, email integration, Telegram connectivity, conversation memory, and related features. The Service runs on cloud infrastructure managed by us.

2. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials.
• Promptly notify us of any unauthorized use of your account.
• Accept responsibility for all activity that occurs under your account.

You must be at least 13 years old to create an account. By using the Service, you represent that you meet this age requirement.

3. Subscription Plans & Billing

KillerBot offers the following subscription options:

• Free Trial — 5,000 credits at no cost, no credit card required. Trial credits are one-time and do not renew.
• Essential — $49/month, includes a monthly credit allocation and standard features.
• Max — $149/month, includes a larger monthly credit allocation and premium features.

All paid subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. You can cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing period.

Prices are subject to change. We will notify you of any price changes at least 30 days in advance. Continued use after a price change constitutes acceptance of the new pricing.

Additional credits may be purchased as one-time credit packs. Credit pack purchases are non-refundable once credits have been used.

4. Free Trial

New accounts receive a one-time allocation of 5,000 credits at no cost and with no credit card required. The free trial allows you to explore the Service before committing to a paid plan. Trial credits do not expire but are non-renewable — once used, you must subscribe or purchase a credit pack to continue using the Service.

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights.
• Generate, store, or distribute illegal, harmful, threatening, abusive, defamatory, or obscene content.
• Harass, impersonate, or harm other individuals.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or related systems.
• Use automated scripts, bots, or scraping tools to access the Service outside of the intended interface.
• Circumvent rate limits, credit allocations, or other usage restrictions.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use the Service to build a competing product or service.
• Resell, sublicense, or redistribute access to the Service without written permission.

We reserve the right to suspend or terminate accounts that violate this policy, with or without prior notice.

6. AI-Generated Content Disclaimer

The AI assistant provides responses generated by artificial intelligence. While we strive for accuracy and helpfulness, AI-generated content:

• Is not professional advice. Responses should not be relied upon as legal, medical, financial, tax, or other professional advice. Always consult a qualified professional for important decisions.
• May contain errors. AI models can produce inaccurate, incomplete, or outdated information. You are responsible for verifying any information provided.
• Does not represent our views. AI-generated responses do not reflect the opinions, views, or endorsement of KillerBot.

You assume full responsibility for how you use AI-generated content. KillerBot is not liable for any decisions made or actions taken based on AI responses.

7. Intellectual Property

The Service, including its software, design, branding, and documentation, is owned by KillerBot and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without written permission.

You retain ownership of the content you provide to the Service (your messages, uploaded files, etc.). By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of delivering and improving the Service.

AI-generated responses are provided for your use. We do not claim ownership of AI-generated content produced in response to your inputs.

8. Data & Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data. By using the Service, you agree to our Privacy Policy.

9. Service Availability

We strive to keep the Service available and reliable, but we provide it on an "as-is" and "as-available" basis. We do not guarantee any specific uptime or service level agreement (SLA). The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control, including outages at third-party providers.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• KillerBot and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
• Our total aggregate liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not liable for the actions, content, or data of third-party services integrated with the platform (including Anthropic, Google, Stripe, and others).

11. Indemnification

You agree to indemnify and hold harmless KillerBot and its officers, directors, employees, and agents from any claims, liabilities, damages, costs, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

You may close your account at any time by contacting us at support@killr.bot or through your account settings.

We may suspend or terminate your account at any time if you violate these Terms, engage in abusive behavior, or for any other reason at our sole discretion. Upon termination:

• Your right to access the Service ceases immediately.
• We may delete your data in accordance with our Privacy Policy.
• Any unused credits or remaining subscription time will not be refunded, except as required by law.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

If you do not agree with updated Terms, you may close your account before the changes take effect.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in California.

15. General Provisions

• Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and KillerBot regarding the Service.
• Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
